39 Days and Counting

Getting fired, axed, dismissed, kicked to the curb, given the boot, being let go, out of a job, sacked, on the out and so on, the list is almost endless when it relates to being terminated from your job.

Of course there are different types of terminations.

There is the voluntary or involuntary termination.  Termination for cause and believe it or not there is even a constructive termination and a mutual termination.

Let's boil it down to the brass tacks.

Voluntary Termination - Basically quitting with or without notice.  This is when the employee fires their boss.

Involuntary Termination - Either with or without cause.

Without cause may be due to downsizing and include layoffs - employees who through no fault of their own are out on the street.

With cause is most often due to something the employee either did or failed to do like their job or failed to follow the rules.

Then there is something called "at-will".

I had to look this one up.  It means that either party may sever the employee/employer relation at any time for any reason "at-will".

Does this mean they can fire you for any reason at all?  No, not exactly.

Apparently they must not violate either federal or state labor laws by their actions.

So what does all that mean?

Here is a very good article by the folks at Wrongful Termination Settlements.com which provides a guide on "How to prove Wrongful Termination in 8 Steps".

So some of the laws include discrimination based upon race, color, religion, sex or national origin, age, being disabled and a whole bunch more.

I recommend you take a read on Equal Employment Opportunity Commission's website at https://www.eeoc.gov/fact-sheet/federal-laws-prohibiting-job-discrimination-questions-and-answers.

Personally, I don't know who this Will person is but it sounds like they are going to get fired.
